DECISION No 17 OF OCTOBER 2, 2001 ON CC No 13/2001

The Constitutional Court decision dismissed the demand from 57 Members of the 39th National Assembly and of the Supreme Administrative Court to invalidate the election of Irena Ivanova Marinova-Varadinova as a Member of the 39th National Assembly from the Simeon II National Movement (NDSV) Coalition from the 18th multi-seat constituency-Razgrad.
Initially the Regional Electoral Commission registered Ventsislav Dimitrov who topped the NDSV Coalition ticket for the 18th multi-seat constituency-Razgrad for the election on June 17, 2001.
Acting on a demand from the NDSV Coalition which had been furnished with information of Dimitrov’s collaboration with the former State Security Service, the Regional Electoral Commission deleted his registration and registered Irena Marinova-Varadinova on the vacated position.
On the Election Day Varadinova topped the NDSV Coalition ticket and ballot.
Irena Marinova-Varadinova meets the MP eligibility requirements under Art. 65 para 1 of the Constitution. She was entered into the ticket in the Electoral Law procedure as willed and requested by the NDSV Coalition central leadership. Political parties and coalitions have the right to nominate and replace or reorder names on the tickets. The NDSV Coalition asked to cancel the registration of the person who initially topped the ticket and replaced him. No other will was later expressed. The ballot bearing the name of the newly registered Irena Marinova-Varadinova received the voters’ support required to get elected. Therefore, the Central Electoral Commission acted rightfully when it affirmed the election of Irena Marinova-Varadinova as a Member of Parliament from the NDSV Coalition.
