DECISION No. 23 OF NOVEMBER 9, 1995 ON CC No. 20/95
Motion by the Council of Ministers asking for an interpretation of Art. 84 item 11 proposition 1 of the C. in the sense to specify the powers of the National Assembly to allow the deployment and use of Bulgarian armed forces outside the country's borders.
The Constitutional Court's interpretative decision ruled that the deployment and use of Bulgarian armed forces outside the country's borders in the sense of Art. 84 item 11 of the C. fall within the exclusive competence of the National Assembly when the deployment and use are for military or military policy purposes. When there is doubt about the military or military policy nature of the deployment, the matter is dealt with by the National Assembly.
In the sense of Art. 84 item 11 of the C. "the Bulgarian armed forces" include the personnel of the units of the Ministry of Defense, Ministry of Interior or other departments that are identified by a law organized at the time of deployment or after with the required arms, munitions and/or equipment given before or after the deployment.
The National Assembly shall not allow to deploy Bulgarian armed forces outside the country's borders without a decision as to the mode and duration of deployment.
The consent of the National Assembly covers the numerical and type specification of Bulgarian armed forces and the place, duration and mode of deployment outside the country's borders.
